Terms of Service

1. Definitions

1.1 Fig6
“Fig6,” “we,” “us,” and “our” refer toFig6 LLC.

1.2 Customer
“Customer,” “you,” and “your” refer to the individual or entity accessing or using the Platform.

1.3 Customer Data
Customer Data means information uploaded, entered, imported, transmitted, or otherwise provided by a Customer through the Platform, including:

• Notes
• Prompts
• Campaign configurations
• Imported contacts
• Uploaded files
• Proprietary account intelligence
• Customer-provided lead intelligence
• Workspace-specific context

1.4 Platform Intelligence
Platform Intelligence means information discovered, generated, enriched, validated, inferred, researched, organized, aggregated, or otherwise created by Fig6 using public sources, third-party services, platform operations, or platform-generated intelligence, including:

• Public web research
• Company profiles
• Contact enrichment
• Validation results
• Signals
• Opportunity identification
• Research supplements
• Contact insights
• Company insights
• Research summaries
• AI-generated intelligence derived from public sources
• Aggregated platform insights

1.5 Subscription
A Subscription means an active Monthly or Annual plan purchased by a Customer.

2. Eligibility

You must:

• Be at least eighteen (18) years old.
• Have the legal capacity to enter into binding agreements.
• Use the Platform in compliance with applicable laws and regulations.

3. Accounts

You are responsible for:

• Maintaining accurate account information.
• Maintaining the confidentiality of account credentials.
• Activities conducted through your account.
• Maintaining access to connected third-party services.

You must promptly notify Fig6 of any unauthorized use of your account.

4. Subscription Plans & Billing

4.1 Subscription Plans
Fig6 offers:

• Monthly subscriptions
• Annual subscriptions
• Limited free trial access
• Alpha and Beta testing programs

4.2 Billing
Subscriptions renew automatically unless canceled before the applicable renewal date.

4.3 Upgrades
Plan upgrades take effect immediately and may be prorated for the remainder of the current billing period.

4.4 Downgrades
Plan downgrades take effect at the end of the current billing period.

4.5 Cancellation
Cancellation prevents future billing but does not immediately terminate access. Access remains available through the end of the active billing period.

4.6 Failed Payments
If a payment method fails or charges are declined, Fig6 can:

• Retry payment
• Suspend access
• Restrict functionality
• Terminate the subscription for non-payment

Customers remain responsible for outstanding fees and charges.

5. Alpha and Beta Programs

Fig6 offers Alpha and Beta testing programs from time to time at its discretion.

Alpha and Beta services:

• Can contain bugs, errors, or defects
• Can change without notice
• Can be modified or discontinued at any time
• Are provided without guarantees of functionality, performance, or availability

Fig6 can suspend or terminate Alpha or Beta access at any time.

Upon conclusion of a testing period, continued access may require purchase of a paid subscription.

6. Bring Your Own AI (BYOK)

Customers are required to connect and maintain their own AI provider credentials for ongoing use of the Platform.

Supported providers include, but are not limited to:

• OpenAI
• Google
• Anthropic
• Future providers supported by Fig6

Customers remain solely responsible for:

• AI provider accounts
• API keys
• Usage limits
• Provider charges
• Compliance with provider terms

Fig6 is not responsible for the availability, pricing, policies, outputs, limitations, or performance of third-party AI providers.

7. Customer Data

7.1 Ownership
Customers retain ownership of Customer Data.

7.2 Import and Export
Fig6 provides tools that allow Customers to import and export Customer Data.

Export functionality is provided on an “as-is” basis and may be subject to technical limitations.

7.3 Customer Responsibility
Customers are responsible for ensuring they possess all rights, permissions, and lawful authority necessary to upload, process, enrich, store, and communicate using Customer Data.

8. Platform Intelligence

8.1 Ownership
Fig6 retains ownership of Platform Intelligence and all associated intellectual property rights.

8.2 Exportability
Platform Intelligence generated through use of the Platform is available for export to Customers.

Exportability does not transfer ownership.

8.3 Retention
Platform Intelligence will be retained following account deletion and can continue to be used for:

• Platform operations
• Product improvement
• Research
• Analytics
• Enrichment
• Validation
• Signal generation
• Service enhancement

9. Product Improvement

Fig6 uses:

• Customer Data
• Platform Intelligence
• Usage analytics
• Operational metrics
• Aggregated information
• Anonymized information

to:

• Operate the Platform
• Maintain the Platform
• Improve user experience
• Improve workflows
• Improve navigation and usability
• Improve enrichment quality
• Improve signal detection
• Improve lead discovery
• Improve ranking and recommendation systems
• Improve platform performance
• Improve security and reliability

Fig6 does not sell Customer Data.

10. AI-Generated Content

AI-generated outputs are provided for informational and productivity purposes only.

Customers remain solely responsible for:

• Reviewing outputs
• Verifying accuracy
• Determining suitability
• Communications sent
• Business decisions made using outputs
• Regulatory compliance

Fig6 makes no guarantee regarding the accuracy, completeness, legality, reliability, or suitability of AI-generated outputs.

11. No Professional Advice

Information, recommendations, research, signals, enrichment results, and AI-generated outputs provided through the Platform are for informational purposes only and do not constitute legal, financial, marketing, compliance, business, or professional advice.

Customers remain solely responsible for decisions made using information provided through the Platform.

12. Automation

12.1 Approval Queue
Fig6 defaults to human-review workflows.

AI-generated communications are placed into an approval queue before sending.

12.2 Auto-Approve Features
Customers can enable automated approval and execution features.

When enabled, Customers assume responsibility for:

• Actions taken
• Communications sent
• Outcomes generated
• Business consequences arising from automated workflows

12.3 Automation Disclaimer
Automation services are provided on an “as-is” basis.

Fig6 does not guarantee automation services will be error-free, uninterrupted, fully functional, or free from unintended outcomes.

13. Third-Party Services

Customers can authorize Fig6 to access:

• AI providers
• Email providers
• APIs
• Websites
• Subscription services
• Other third-party systems

Customers represent that they possess authority to grant such access.

Fig6 is not responsible for the availability, actions, policies, performance, security, or functionality of third-party services.

14. Acceptable Use

Customers may not use Fig6 for:

• Spam
• Fraud
• Phishing
• Harassment
• Impersonation
• Malware distribution
• Deceptive marketing
• Circumvention of unsubscribe requests
• Illegal solicitation
• Violations of applicable laws

Fig6 can suspend or terminate accounts that violate these restrictions.

15. Compliance

Customers remain responsible for compliance with all applicable laws and regulations, including but not limited to:

• CAN-SPAM
• GDPR
• CCPA / CPRA
• State privacy laws
• Industry-specific regulations

Fig6 does not guarantee compliance with any specific legal framework.

Customers are responsible for ensuring they possess an appropriate legal basis to collect, process, enrich, store, and communicate with individuals using the Platform.

The Fig6 Data Processing Addendum (“DPA”) is incorporated into these Terms by reference and applies to the processing of Personal Data by Fig6 on behalf of the Customer.

16. Account Deletion

Customers can self-delete their accounts.

Upon deletion:

• Customer Data will be deleted in accordance with Fig6 retention policies.
• Platform Intelligence will be retained.

Fig6 reserves the right to remove Customer Data associated with accounts that remain unsubscribed and inactive for more than ninety (90) days.

17. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIG6 DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND PERFORMANCE.

18. Force Majeure

Fig6 is not liable for delays, interruptions, failures, or performance issues resulting from causes beyond its reasonable control, including:

• Internet outages
• Cloud service failures
• AI provider outages
• Third-party service interruptions
• Cyberattacks
• Labor disputes
• Natural disasters
• Government actions
• Utility failures

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIG6' TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER TO FIG6 DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

20. Indemnification

Customers agree to indemnify, defend, and hold harmless Fig6, its officers, directors, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Customer Data
• Customer communications
• Customer use of automation features
• Customer regulatory violations
• Customer misuse of the Platform
• Customer violation of these Terms

21. Arbitration & Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).

Arbitration shall:

• Be conducted on an individual basis
• Not be conducted as a class action
• Be conducted remotely where permitted
• Be governed by Delaware law

Either party may pursue an individual claim in small claims court where jurisdiction permits.

Customers waive any right to participate in class actions, class arbitrations, or representative proceedings.

22. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

23. Changes to Terms

Fig6 may modify these Terms from time to time.

Material changes will be communicated through the Platform or other reasonable means.

Continued use of the Platform following the effective date of revised Terms constitutes acceptance of the updated Terms.
